Terms of Service

These Terms of Service ("Terms") govern your access to and use of TunnelBoatTerror.com, the Tunnel Boat Terror video game, demos, test builds, downloadable content, official community spaces, online features, support channels, and related services operated by Falcon Racing Studios, LLC ("Falcon Racing Studios," "we," "us," or "our") (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services.

1. Eligibility And Platform Requirements

You may use the Services only if you are legally permitted to do so in your jurisdiction. Certain features may require a compatible device, operating system, internet connection, third-party platform account, or acceptance of additional platform terms.

If you are under the age required to enter into a binding agreement where you live, a parent or legal guardian must review and agree to these Terms on your behalf where required by law.

2. License To Use Tunnel Boat Terror

Subject to these Terms and any applicable storefront or platform license, Falcon Racing Studios grants you a limited, personal, revocable, non-exclusive, non-transferable license to install, access, and use Tunnel Boat Terror for personal, non-commercial entertainment purposes.

The game and all related software, code, graphics, models, characters, boats, vehicle designs, tracks, environments, audio, video, text, logos, trademarks, interfaces, documentation, and other content remain the property of Falcon Racing Studios or their respective licensors. No ownership rights are transferred to you.

3. Prohibited Uses

You may not use the Services in a manner that violates applicable law, these Terms, platform rules, or the rights of Falcon Racing Studios or others. Unless expressly permitted by law or by Falcon Racing Studios in writing, you may not:

• copy, redistribute, sell, lease, sublicense, commercially exploit, or make unauthorized derivative works from the game or Services;
• circumvent access controls, security systems, anti-abuse systems, authentication, licensing, or technical restrictions;
• reverse engineer, decompile, disassemble, extract, scrape, or otherwise attempt to obtain source code, proprietary assets, protected data, or non-public systems except where such restrictions are prohibited by applicable law;
• use cheats, exploits, bots, automation, unauthorized modifications, malicious software, or other tools that interfere with fair play, testing, security, or normal operation of the Services;
• probe, attack, overload, disrupt, damage, or gain unauthorized access to any website, server, network, account, game service, or third-party service used by Falcon Racing Studios;
• impersonate Falcon Racing Studios, its staff, partners, moderators, other users, or any other person or organization;
• use the Services to distribute malware, fraudulent material, unlawful content, threats, harassment, or material that infringes intellectual-property or privacy rights.

4. Gameplay, Racing And Online Conduct

Tunnel Boat Terror is a racing game that may include competitive, simulation, arcade, multiplayer, testing, leaderboard, community, or other interactive features. Where those features are available, you are responsible for your conduct and for complying with any posted rules, race rules, testing requirements, community standards, or platform-specific policies.

Falcon Racing Studios may investigate cheating, manipulation of race results, leaderboard abuse, exploit use, disruptive behavior, malicious activity, or other conduct that threatens the integrity or security of the Services. We may restrict or terminate access to affected features when reasonably necessary to protect the game, our users, or our systems.

5. Accounts, Testers And Access Credentials

If a Service requires an account, tester identity, access code, product key, platform entitlement, password, or other credential, you are responsible for keeping that credential secure and for activity performed through your access.

You may not sell, share, transfer, or distribute restricted testing credentials, private builds, confidential materials, or non-public access unless Falcon Racing Studios expressly authorizes you to do so.

6. Demos, Alpha/Beta Builds And Development Content

Pre-release, demo, alpha, beta, prototype, test, or development versions of Tunnel Boat Terror may be incomplete and may contain bugs, missing features, compatibility problems, crashes, balance changes, placeholder assets, or other defects. Features, vehicles, physics, tracks, art, performance, controls, saves, and other content may change or be removed at any time during development.

Unless Falcon Racing Studios expressly states otherwise in writing, access to a development build does not guarantee that any feature, vehicle, platform, release date, online service, or other functionality will appear in the final product.

7. Purchases, Storefronts And Refunds

Purchases, downloads, licenses, payments, refunds, subscriptions, or product entitlements made through Steam, itch.io, Epic Games / Fab, or another third-party storefront are also subject to that provider's terms, refund rules, payment policies, and account requirements.

Falcon Racing Studios may receive limited purchase or entitlement information from those providers where necessary to deliver or support the applicable product. Payment-card processing is generally handled by the applicable storefront or payment provider.

8. Updates, Patches And Service Changes

We may update, patch, rebalance, modify, suspend, replace, or discontinue portions of Tunnel Boat Terror or the Services. Updates may be required to continue using certain features. Online services, multiplayer functionality, community integrations, testing systems, or third-party integrations may be modified or discontinued when reasonably necessary for development, maintenance, security, legal, or operational reasons.

9. User Content, Feedback And Submissions

You retain any ownership rights you already have in content you submit to Falcon Racing Studios. By submitting screenshots, videos, bug reports, suggestions, feedback, comments, posts, designs, or other material through the Services or official community channels, you grant Falcon Racing Studios a worldwide, non-exclusive, royalty-free license to host, reproduce, display, transmit, and use that content as reasonably necessary to operate, moderate, support, test, improve, and promote the Services.

Feedback, ideas, feature suggestions, balancing suggestions, bug reports, and similar submissions may be used by Falcon Racing Studios without obligation to compensate you, provided we do not claim ownership of material that remains legally yours.

You must have the rights necessary to submit any content you provide and must not submit confidential information belonging to another person or organization without authorization.

10. Discord And Other Community Platforms

Official or Falcon Racing Studios-managed Discord servers, forums, social-media pages, community groups, and testing communities may have additional rules. Those rules form part of the conditions for participating in the applicable community.

We may moderate, remove, restrict, preserve, or review community content or activity when reasonably necessary to enforce rules, investigate reports, address harassment or abuse, protect security, maintain records of moderation actions, or comply with law.

Discord, Steam, itch.io, YouTube, Twitch, X, TikTok, Instagram, Epic Games / Fab, and other third-party services operate independently and are subject to their own terms and policies.

11. Intellectual Property And Brand Use

"Tunnel Boat Terror," Falcon Racing Studios names and logos, game artwork, branding, and related intellectual property may not be used in a manner that falsely suggests sponsorship, endorsement, affiliation, or official status.

Nothing in these Terms grants permission to use Falcon Racing Studios trademarks, logos, commercial artwork, game assets, or other protected materials for merchandise, commercial products, advertising, another game, or another commercial project without prior written permission.

12. Third-Party Content And Links

The Services may contain links to or integrations with third-party websites, applications, storefronts, communities, videos, social networks, payment processors, security providers, or other services. Falcon Racing Studios does not control and is not responsible for the availability, content, security, privacy practices, or terms of third-party services.

13. Suspension And Termination

You may stop using the Services at any time. Falcon Racing Studios may suspend, restrict, or terminate access to a Service or feature where reasonably necessary because of a violation of these Terms, fraud, cheating, abusive conduct, security risk, unlawful activity, misuse of restricted builds, nonpayment, platform action, or discontinuation of the applicable Service.

Provisions that by their nature should survive termination—including intellectual-property provisions, disclaimers, limitations of liability, and dispute-related provisions—will continue to apply after termination where legally permitted.

14. Disclaimer Of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. Falcon Racing Studios does not guarantee that the Services will always be available, uninterrupted, secure, error-free, compatible with every device or configuration, or free from defects.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded or limited.

15. Limitation Of Liability

To the maximum extent permitted by applicable law, Falcon Racing Studios and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business opportunity, or use arising from or relating to the Services.

Where liability cannot legally be excluded, Falcon Racing Studios' liability will be limited to the maximum extent permitted by applicable law. Some jurisdictions do not allow certain exclusions or limitations, so some of the limitations above may not apply to you.

16. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.

17. Governing Law And Disputes

These Terms are governed by applicable law, subject to any mandatory consumer-protection or jurisdictional rights that apply where you live. Before filing a formal claim, you and Falcon Racing Studios agree to make a reasonable effort to resolve the dispute informally by contacting the other party, except where immediate legal relief is reasonably necessary.

18. Changes To These Terms

Falcon Racing Studios may update these Terms to reflect changes to the game, the Website, community features, third-party integrations, business practices, or legal requirements. The "Last Updated" date identifies the current version. Continued use of the Services after revised Terms become effective constitutes acceptance where permitted by law.

19. Severability And Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms, together with the Privacy Policy and any additional rules or terms presented for a particular Service, constitute the agreement governing your use of the Services.
